Filing Successful Disability Compensation Claims – 60 Minutes

Tom will discuss how to use VA’s new paperless system for filing a successful original claim for Disability Compensation.  If you know how to file a successful original claim then you know how to put together a successful appeal.  The process is the same.  The only difference between an original claim and an appeal is that with the appeal you have to go into the record and find out what went wrong.  Once you know that, then you can use the strategies for original claims in the How to Apply Book to follow through with your appeal.
 
Issues discussed will be determination for veteran status, various rules pertaining to filing claims, eBenefits versus paper claims, obtaining service treatment and personnel records, obtaining medical nexus opinions and obtaining DBQ’s.  Deficiencies in the current paperless process will be pointed out and strategies suggested for how to avoid those deficiencies.  In addition, Tom will address what to do with an adverse decision instead of immediately filing an appeal.
 
It is impossible to cover the subject of Disability Compensation claims in only 60 minutes.  Tom’s presentation will reference sections of the 576-page handbook, How to Apply for Department of Veterans Affairs Benefits for Veterans and Their Survivors, that you receive with this course.  Well over 350 pages of the handbook are devoted to Disability Compensation claims.
 
In addition to the handbook you receive a claim support disc with over 120 different forms and surveys that can be used for Disability Compensation claims.  The support disc also contains thousands of pages of reference material to include 2018 Rate Tables, VA Adjudication Manual M21-1 as of January 2018 (roughly 3,000 pages), the VASRD (Title 38 CFR Part 4), Title 38 CFR Part 3, useful contact lists, checklists, scores of information pieces pertaining to specific claims and numerous compilations of statistics and other material pertaining to the Department of Veterans Affairs.

The course does not include any credits for ethics.

**This training course also meets the requirement for 3 hours of CLE for maintaining accreditation with the Department of Veterans Affairs as found in Title 38 CFR 14.629 (b).   This course will also meet the mandated  3 hours of first year CLE requirements as well as any ongoing 3 hours of CLE on veterans law and procedures required every two years (see 38 C.F.R. § 14.629). The information in this course and the detailed handbook that comes with the course are a result of knowledge derived from our participation in thousands of claims for veterans disability benefits.  If you wish to become accredited by the Department of Veterans Affairs, please contact us and we will provide you instructions on how to become so.  It takes several months to become accredited and if you wish to use this course to meet your first year requirement for VA Accreditation CLE, you must file your application at least 4 months before attending the conference.
